last friday a guy run a red light and smashed into my holden vn commodore that just got re-sprayed.
anyway i went and got 3 quotes for him and they ranged from $1700 to just over $2000.
now the S.O.B wont pay up the cash and hes not insured.
anyone got any thoughts???

In the future go for 3rd party fire and theft! It costs me just over a dollar a day and im 18 and on my P's.
Its well worth it just in case. If something happens and its not your fault, the insurance company will completely cover it.
You could take the guy to court if you really wanted to?

Your local motoring association should have legal guys you can talk to.
By motoring association you mean like RACV, RAA etc.? Differs in each state?
your in NSW so speak to the NRMA they will give you some legal advice if your a member (costs like $20 and you can do it over the phone)
You will be able to take him to court, but i have a feeling if you just threaten the bloke - just say look here are the facts, YOU hit me, YOU are in the wrong, YOU don't have insurance, he might just shit himself and pay you. Tell him if he wants to fight you in court, not only will he have to pay for a lawyer, but if he loses he has to pay for YOUR lawyer (true)
Make him realise that he's in the wrong, and that any judge/magistrate will see it that way. Make him realise that once they do, he's in WAAAAY more shit than his is now, especially as the law is involved, as its illegal not to have insurance (unless he has CPT)
Apart from that, yeah you could bash the f*ck!
Just FYI - if you get insurance and then modify your car (bodykit) you just call your insurer, let them know, and they change your policy a little bit. You might have to pay a small amount, but bodykit is worth nothing to insurance so it wouldn't make much difference
threaten to take him to small claims tribunal. if the cops fined him for running a red, you're sure to win. you did call the cops right? if not it's going to be hard, as he will most probably lie about what happened.
Are you sure hes not insured? Small claims is the best way to go. get any witness's you can. If he is insured and is telling you he is not section 54 of the insurance act allows you to lodge a claim on his behalf and be cash settled less the excess if any. but you must try to use other avenues first. ie legal and civil. Make sure you report it to the police so its formally recorded. If you have any questions about dealing with insurance companys let me know..

Yeah if you didnt call the cops or report the accident within 24 hours then you have no chance of getting any $$$
you need witness's....
you need.. Reciepts & Quotes for repairs....
you need to contact the police as A.S.A.P and tell them what happened..
You have to give them all his details..
the Police will tell you what to do next... i.e. take him to court etc...
Make sure to take Photos,Witness's,quotes to fix etc... when u go to court.
Go and get 1/3 party insurance now that way when police say well do you have insurance you can say Yes.If you say you dont have any insurance at all then they will say tough luck & they wont do a thing.The insurnace company prob wont pay but atleast it looks good to police so they actually go after the bloke.If police say why you only just got insurance say you just spent $2000 on paint job and that you where getting insurance in few days and this happened.It will make you look good in their eyes so they will something,Also depends on your driving record as the police will check this also to make sure your not pulling a shifty or something.

or my other friend who dumped his car 60mm on racv, also found him self un insured, AAMI are better but unless your over 25-30 they really DO care

was gonna let it slip then go to just car, but i blew my engine so i wont be needing insurnace, cars gonna sit in the garage....

I just went and checked with AAMI about what I can and can't do to my car. I was told only one major modification before I'm 25. Major mods include suspension, brakes, rims (even a +1 fittment), bodykit, sound system...
Minor mods like upgrading the headlights and putting in seat covers (it matters to some insurance agencies) don't matter so long as they don't exceed a certain value.
If you change ANYTHING you have to tell them.

Since i got my insurance with Allianz, I have gotten my entire bodykit, upgraded rear suspension, sports steering wheel (removed now anyway), upgraded sound system, alarm, window tint (removed now as well) and I have been able to change my policy every time.Originally Posted by PaRaDoX616
