Default Tint company sratched my car!!!

today dropped me car in to be tinted, i new where all the scratches on my windows were etc. I had some slight scratches on the back 2 windows but nothin on the fronts ones, they were mint. i came back to pick it up and found a scratch on my drivers window about 10cm x 2cm. i told the guy that it wasnt their before i dropped it in and he said well we didnt do it and so on..... i then told him im not paying unless he fixes the ****ing massive scratch, he had the keys to my car so yer, had to eventually pay (****ing cocksucker)

my question is does anyone no the procedure of how they window tint??, what tools or anything they use.

to apply the tint they use a plastic spatular like tool and a sprey bottle.

to remove the old tint they use a heat gun and razor blade (or similar)

hard to tell if they scratched it or not from the outside, it coulda been your clips behind the weather strip when they wound the window down they probebly knocked the trim inward.
and its scratched when they wound it back up

As far as I understand they do not have right to refuse to give you your car back. That is just standover tactics.
They can of course start proceedings to recover their money, none of which should include holding your property as ransom.

the tint place does not have the rights to hold you keys without prior notification of entering a contract, you can tell them that if they do not fix or rectify the problems that they have created you will be back with consumer affairs.

You might want to bring in the cops with you next time you go in to try pick up your car...technically the tinters cannot hold onto your property and refuse to return to you without payment for services, parts etc. as it is actually called theft on their part. But you as a consumer do have a right to have the scratches fixed by the tinters at their cost if it can be proved that it was done by them...this could be evidence such as photographs before the car was taken in, etc. Other than that, you might need to get yourself a pretty good lawyer.

Will understand if you don't want to, but what state/company was it? If it was outside Vic doesn't matter about company, but I'm planning on getting tinting soon and wold rather not have "more" scratches on my windows...

Actually your wrong, If you put you car in for a service type arrangement with a company then they have all the rights to hold your car until they receive payment or come to some satifactory arrangement with yourself.

If you attempt to take back the car without making good payment then your committing an offence of stealing. Sorry, buts the law as it stands.

Most of the time these types of issues can be sorted out with the manger or the owner of the retail store, but can lead to either party seeking civil action.

If you call the cops, then the cop will tell you the exact same...why because I am one...

Its your word against his, not a good scenario. A lawyer would not waste his time with this, then again...he is getting paid so he most probably would.

Taking pictures prior to the getting any work done and pointing out any damage to the store is excellant advice, but you need a witness to the event to give weight to your arguement..

yes in the eyes of the law it would be stealing but prior notification of this BEFORE entering into a contract, weather verbal or through .sales (lets face it its a contract) the tint company is required to put signs up notifying customers before they enter any contract hat thier keys will be kept until some payment terms are reached (simple contract law) if terms a conditions of that contract are added after the contract start date the contract is null and void. it would not stand up in a disctrict court like policehoon says you need evidence, and a witness to come to the table without those your stuffed.

That sucks man... I got my windows scratched when the panel beater fitted my electric window with crap parts. The parts broke about a year later so I couldnt go back and complain. When I put up the windows it scratch on the leaver arm.

The worst thing thats ever happened to me was I got my car back from a panel beated (different company) and the stupid workers must have left my back windows open in the rain when listening to the stereo. The car STANK like vomit when I got it back. I took it back and they refused fault. I persistent and they agreed to fix it. They didn't, they dried it out but it smell was still there. I went to SuperCheap Auto and bought come carpet cleaner and after a few weeks of constantly cleaning it the smell went away. I hate idiot who works on your cars. Some have no respect for others property.

Also when I had my VN (my first car :-D) after an front accident the panel beaters gave it back. It looked great. I drove it at night, turned on the high beam and the lights went out. I turned them back on and each time I went to high beam they went out. They said they fixed it when I took it back... but when I tested it with them there, the flippin' engine went off when I turned on the high beams. They had the car for an extra week to fix the fault.
