I'm not sure exactly the rules regarding public liability. But I do know that Just Cars are trying to recover the money from the clubs insurance. The total repair bill is just under $7000 but they will only get $1200 if they take my excess. Also I talked to RACQ legal advice and they tell me that since I claimed through my insurance company I cannot sue or be sued if Just Cars fail to recover the money. Basically if Just Cars say I have to pay my excess, then I cannot take civil action against the club or the property owner. Apparently because when I claimed through my insurance I got them to act on my behalf. Also some stuff about double-dipping and all that.
On the positive side my work have let me use their company car to drive around in until my car is fixed. On the negative side its a Ford. Nah its a good car, a BA Fairlane Ghia, and not an ounce of leather, all vinyl, stupid ford, but does have a 6 cylinder with 186kw and 380Nm of torque
.
Also I talked to the smash repairs and what they are going to do is strip the interior, cut the roof off, put a new one on, and then rebuild the interior. They are also replacing the right-rear door, and repainting the roof, both side doors and the rear quarter panel for some reason. But they also said that they aren't going to replace the side airbag, I though it would of needed replacing because the damage was so close to it, is this right?
