My holden VY Ute got stolen and burnt out 2 bout months ago and just been under investigation by the insurance company and they got a forensic locksmith to look at the car and he found only 1 out of the 10 pins that are in the ignition and it wasn't damage, So is there any way that anyone know of that some one cud of stolen my Ute without 1 of the pins getting damaged??? You need to take them to court. Seek legal aid. For one reason or another they are suspicious, but 9/10 threatening not to pay is a bluff. A nicely typed note from a legal firm with official letterhead may well get results. If not, you may need to consider puruing it further. There will be costs involved - that you can recoop IF you win. Maybe you can get free legal aid?How much is the car worth? If you can pursue it through small claims court then you can represent yourself, and costs are minimal.

If you take your car for servicing or other work and leave it, the key can be copied and programmed to open and start the car and you will not know about it. That's not rocket science and the insurance company would know that was a possibility. Once a perpetrator has your key and your address or your work location they can just follow you and steal the car at their leisure.
Insurance companies have to be cautious as there are a multitude of low life scum people out there trying all sorts of ploys to defraud them. (Then we all end up paying in higher insurance premiums). They are not just going to pay up if there is suspicion of fraud and nor should they until investigations of suspicious thefts are complete. You may well be a completely genuine claimant but something has given the insurance company cause to investigate the theft and destruction.

I know someone that tried it on with an insurance claim. Insurance company got suss as the near new baby capsule had been taken out of the car before it was 'stolen'. Claim refused, and good on 'em. Someone else I know that was 'claim refused' but it was genuine so they put up a fight and the insurance company paid up long before court.

Legally, all decisions are appealable, just be advised that you will need something other than your word, to counter the forensic locksmith (wasn't aware we had those. Just locksmiths). Your best option is to seek the assistance of a qualified lawyer, either paying the money or seeking the free legal advice that the firms occasionally do (chase up legal aid in your local area and go from there). Lay your case before them, and also what the Insurance company have to say it wasn't stolen, and let them decide if your case has legs.
I agree with brokenikon - well said. The thing I don't get is how the decision could be made solely on the locksmiths opinion - so, if the lock was not tampered with then they picked the car up with a crane (or more likely a tilt tray) or they had a key (previous owner, dodgy mechanics employee) I even imagine it's possible for someone to get your VIN etc by going through your mail and getting a key cut? Perhaps they have other reason to doubt? There could be other possibilities, but as brokenikon says - get yourself some legal advice asap.

Dont put up with this shit mate... Get yourself a lawyer ASAP.. they are trying to scare you out of your claim. It happens with every claim, they will try and find any possible angle they can. Surprisingly, many people do get scared into thinking they have nowhere to go. You can speak with legal aid and they will explain your options but I lawyer will soon have this sorted.
If you're interested in finding out a bit more about how these insurance companies work, take a look at the Michael Moore documentary "Sicko" .... its the exact same but with health insurance.. a great watch!
If it was hot wired, i think the immobilizer wont go off (unless u know the wires to cross to disable that first prior to ignition wires to cross).
Dosent matter anyway, your still within your right to claim for stolen car. If they are refusing based on only that I would suggest you look towards getting a lawyer in most cases you can claim court costs back from the insurance company as well.
The issue these days is, people get behind in there repayments decide its all too hard and go take there car and light it up and say it was stolen to make life easier and repay the loan from payout. Thats one of the issue these days.
A quick swap of the BCM/PCM and the key paired to those will hotwire most modern commodores.

You obviously called them and reported it stolen. Statement should have been made.
Second Report should have come from the police when the car was found/how it was found/and if any prints etc could be lifted
Surely this would have some credit with the insurance co. but as said seek legal advice the sooner the better.
