even though the OP stated that the owner wanted nothing to do with it and true if it has one of those stickers it will last 1-2 weeks before being a chassie lol, why let it go to waste?
just talk to the owner and the cops and youll probably get it legally at least your arse will be covered then.
if the owner doesn't want it (as has already been stated in this thread) then go for it. Everyone saying "how would u feel"... If I abandoned my car on the side of the road for two months I obviously don't want it so I would feel fine lol
you need to get owner to sign a reciept to say change of ownership take the rego down or vin and ask the queensland transport for information if they wont help you can do it through the police the cops wont tow it if its registered and has 4 inflated tyres on it.... so if you wanted rid of it take plates and pop tyres but thats another argument for another time.... that guy was pissed but the car was there for 6 months and on a main road one night the cops just stopped and took plates and let down tyres next day they came and took car ????
You could always argue a right to possession, i.e. you found it, your in possession of it and you have made plenty of reasonable efforts to contact the owner therefore you can have it. If so, usually with goods (not certain about cars) you will gain a possessory right to the goods which gives you a title to sue, rather than ownership. (i.e. find a wallet on the ground, hand it to the police (they try and contact the owner, but can't) you actually have better rights to the wallet than the police do.) I dunno, thats from a legal point of view regarding a basic trespass to goods.
All tyres are popped and front is banged in pretty bad. I might try to get the (supposed) owners contact details. Ill also try the local cop station to get some legal advice. Its seems pretty hard to tell whats right/wrong. Obviously if the car is stolen then I should report it. Might make a trip out tomorrow
Gees, a lot of legal experts out there. "Finding" a derelict/abandoned/damaged vehicle sitting on the roadside for months doesn't mean it's finders-keepers until you can prove ownership. If you find a wallet, you hand it to the police and they return it to you if they can't identify the owner. They don't just give it back to you and say it's yours. The same thing goes for a car. If you are interested in getting it, there are ways of contacting the owner. It probably varies from state to state, but consulting the local police would be a good start. Privacy laws prevent them from giving you the informatrion over the counter but they should be able to advise you on the right course of action. To the dills that say "just tow it", you're wrong. Simple as that. Being charged with theft of a vehicle isn't worth the few bucks the car might represent to you, and you end up empty handed anyway. (No car and a criminal record).
In some cases the owner could be locked up and cant pick it up, ive lost 3 car's because i couldnt get it removed or picked up,
hmm that walkinshaw ve has been parked outside with nobody near it for 10 mins, might go help myself to a supercharger....... must be dumped right?
The VL that's donated it's running gear for my RB30 conversion on the VB was found in similar circumstances. Was sitting behind shops for weeks. Kid's had kicked in the panels, smashed the windscreen, thrown housepaint all over it. Other than that, damm thing was complete. In fact i drove it on and off the tow truck. Here's how i got it (i'm in NSW so your laws might be different) Rang the local police station and told them about the car and how i wanted it for parts. S***e from Woy Woy LAC contacted last registered owner for me, before he could call me back to say he'd got in contact, they were already on the phone to me. Seems they didn't want it, had nowhere to put it, it'd been trashed and council wanted money to tow it if they didn't spend money to tow it themselves. Grabbed a reciept from them and got ol mate at woy woy wreckers to tow it home for me. Turned out last rego'd owner sold it to his little bro, little bro drove unregistered and unlicensed.... got locked up..... cops took plates off car and the car sat long enough for the derro little shits around here to start trashing it.... So champ, call the local LAC whilst at the car, read out all the rego label info to them so they can get prev owner to contact you. Job done, piece of cake.
I know this is an old thread but ffs! Firstly if it's only the front that's crushed, we all live in hope that a massive tree falls on it and finishes the job. That said, If the car isn't yours then what makes you think you can just go help yourself to it??? Wtf is wrong with you people??? Reaper
If i was told the owner didn't want it, then i'd tow it. The owner most likely isn't going to charge you, and the nieghbours probably wouldn't report you. Either they wouldn't know if it was your car or not, or they'd just be glad that they eyesore is gone from the front of their house. Fair enough if it was stolen and dumped and most likely that it will be recovered at some point, but that's not the case. The old saying, if you don't want it, i'll have it. Goes to find flame suit haven't needed it in a while !
still doesn't give you the right to just take it would be so funny if the car was stolen and dumped there and everyone is told the owner doesn't want it so someone tows it away and gets caught and charged with stealing it originally could turn into a legal nightmare
Not worth the risk. You want parts, get them from a wrecker or something. Cheaper than a fine. Sent using Tapatalk
LOL "the bloke who came to the door said it had been their for months" so yeah i really don't think the owner could give to shits about it. And if it was a members car then i don't think it would sit overnigt let alone months. im not saying take it but if you don't someone else will
. "sorry your Honour.... I was told the owner didn't want it so I stole it....." Here's a tip - how about asking the owner and getting a written receipt (if either of you are actually capable of making such thing. An X or even a stroke of the pen can constitute a signature). Here's another tip. in 99% of cases the owner doesn't charge anybody in Australia. :bang: I did but meh - stupidity is timeless. Reaper
I bet the minute the previous owner of the abandoned car realises you made money from it, they will demand some form of compensation. They leave it because they think it's worthless and can't be bothered doing anything about it. But once you put some value back into it, they will probably scream blue murder that it was stolen and they want their money. Not worth the risk and like others have said before, you can't just assume you can help yourself, just because the owner is a douche. There is a reason there is a process to have it transferred to you, it's so the previous owner can't then change their mind and come after you for what little cash or value you got out of their car.
