The issue here is that Palm was one of the innovators of touch PDA phones and have many patents to do with that. That most touch phones would infringe... just they are not being dicks about it.
And if it came down to it... Apple could wipe Palm off the map... not because they would definately win a legal battle... but because they could tie up palm in a long and costly legal battel... this would send palm over the edge.
It's like apple are scared of someone giving them some competition... and patenting the multi touch pinch and spread gesture... please... next apple will say your not allowed to pinch your girlfriends nipples or spread her *beep for the kiddies* because you are infringing their gesture patents...
