Handbreak Fail - Now have a damaged rear bumper.

Today my Cruze rolled down my driveway into a low tree, severely damaging the rear bumper. We recently received a letter from Holden regarding the hand break, and the car was taken in for a service.

Is this going to be my own problem? Given that Holden know the handbreak is dodgy, is there any way they are liable for these damages?

Edit: The hand break was on, and the car rolled backwards.

Take the Car in and show the Service Dept the damage. GMH has Insurance for things like this. Make a Claim on them for the damage.

If you have no success, then make a claim to Consumer Affairs.

Thanks a lot mate. We're not so hard up that we cant pay the insurance excess next week, and then we will look into getting the money back off GMH. I really don't like our chances, but it's worth a try.

Make a claim on GMH in writing before you have repairs done.

Has it been repaired for the original fault you received the letter about?

If it has only been inspected, and is going back for repairs later, I think they will put the blame on you. You would have known about the issue, and should have taken measures to secure the car if the handbrake should fail.

This recall has been out since May. When did you receive the letter and what steps have you taken since you knew of the defect to return it for repair and mitigate any potential for damage?
