Oh, and if you plan to continue the fight but want the car repaired because Holden won’t currently meet their obligations, you should get a specialist engineering firm (that can attend a small claims court as expert witness if needed) to strip the engine and asses the cause of the fault and report whether it was due to late oil change... Then rebuild it correctly at your preferred place...

That way when you go to small claims court, you’ll have evidence that Holden refused warranty, the cause was not late oil change and that Holden were simply being arsehats... the 3rd party costs to repair what Holden should have... With such preparedness you’re in a better position to get the 3rd party lifter repair (and possibly other repairs due to for example piston slap due to excessive bore clearance) awarded AND you may get the investigation costs of engineering firm and their attendance reimbursed as consequential loss (maybe) if the judge decides Holden were being arsehats...

1. I’ll keep fighting the issue with Holden and take it further if need be but should I get the old girl fixed first? I’m concerned that further delay could do significant damage and repair costs could blow out.

Are you still driving the car?
How long has this been going on?

How much late ?
8000km. No excuse really apart from I was working a lot (driving 700km) a week and couldn’t get the car into Holden for scheduled service. Changed the oil and filter at 30k but don’t have proof of service so they rejected my claim.

8000km and no proof of service basically means you voided the warranty on the engine at minimum and any acl case will be hard because they can claim the damage was due to the oil not being changed correctly.

Barely driving it as I’m concerned about further damage, that said we only have one car so need it dome times. Be lucky if I’m doing 50km a week.
I first noticed it around 45000k but honestly didn’t think much of it as the engines are known for been a bit noisey. About 1000km later I noticed it was taking long to disappear and started doing some homework (came across RonBurgundys issues). Pretty much stopped driving it until COVID restrictions lifted and I could get it into Holden for its service and to check it.

Oddly the head mechanic at Holden said it wouldn’t be an issue to keep driving it haha.

Well that’s great hews haha.

Seriously though thanks for the info.

Makes me wonder though, regardless of any Holden warranty. Surely under ACL you could argue “reasonable Expectation” that lifters will not fail on a new engine. It’s not like it had bad oil or no oil in it?

Cheers,

Out of interest anyone know an honest and reliable mechanic in Brisbane that could do a job like this? Also was the Holden estimate accurate?
