"Road Legal" would require emissions and engineering certification.

also filter element as to why harrop has designed theres as they did, is that cable throttle ? the 2006+ e38 ecu can not do cable has to be electronic throttle no matter what

I've seen the harrop one, there's also filter options for the one show in picture supplied, I believe it is cable throttle however I've seen this style ITB and other's that are cable throttle and running on Ls2 onwards from my understanding they also use a aftermarket ECU.

You would need to contact an approved engineer in your area for that info.

You likely can owner cert that and just hope you don't get an emissions test which is about as likely as Trump winning the election.
It will likely pass a emissions test anyway as it's not really changing much.
A cam is far worse than an intake in that department.
