Updating our earlier Video and post; our VF2 LS3 engine's cold start noise is now with QCAT under Australian Consumer Law consideration. We put the application in the day before Full Factory Warranty ended. We have a lot of 'disturbing' evidence that contradicts GM Australia's claims that will come out just prior to a hearing date (some time away and yet to be set).
Before preparing the next comprehensive video we await response by Respondents 'Dealer Eager Automotive Limited' and 'General Motors Australia and New Zealand' to QCAT's recent directions regarding our disclosure requests.
GM Australia's bullying, deception and manipulation under ACL needs to be challenged - our matter has also been raised to the ACCC and
Department of Infrastructure, Transport, Regional Development and Communications.

FYI - Our vehicle came out of Full Factory Warranty on the 15 August 2021 - we understand people inside and out of warranty with LS3 lifter problems and/or excessive Piston Slap should raise concerns to the above Federal Offices, particularly under Recalls asap.

GM Australia: 'Reference to our letter provided to you on the 30 April 2021, in addition to the recent assessment carried out by our GM representative we have deemed your reported engine noise to not be in any way detrimental to the operation or longevity of the engine'.
My vehicle was well treated and properly maintained and Holden Dealer serviced (currently just over 40,000Km) - GM Australia should not be permitted to sell vehicles in Australia if it avoids compliance under Manufacturers Warranty and/or under Australian Consumer Laws. I would never take a chance buying another GM product, ever again.

this kind of thing happens more than you think in australia and it is not just gm, ford, toyota, vw etc all have history in this type of chitfcukery.
they all know with most customers they can get away with it and the fines are usually so weak they they just dont care.

in the last 15 years gm has been caught up in a few scandals where they supplied defective vehicles and the customers were mistreated, warranty claims denied, lies about their rights, false claims of the issue not having an impact on the longevity of the affected part.

the captivas were one bad set and then the colorado engine drinking oil like it was a fuel additive are among some of the big ones.
many customers were denied replacement engines with gm using a "self imposed" threshold of consumption which was first 2l then bumped to 2.5l when they realized that the majority were using over 2l but under 2.5l.

one popular case was about ken and wendy knox, they were delivered a new defective colorado and they went through hell with the dealer and gm and it was in the qcat for years, it started somewhere around 2017 and it was finally resolved in july 2021 with them returning the vehicle and getting a full refund.

it took them years to get a resolution using the australian consumer laws.

this is an information bulletin on the problem and it clearly describes the fault but somehow it still took years to get a refund which was required by consumer law.

Yet in USA, GM repalced LSA superchargers that made rattling noise at idle even though it casued not issues to power or performance...

Owners of these potent 6.2L, 556hp (580 in Camaro), LSA-equipped factory hot rods complained of "loose marble" rattling sounds at engine speeds below 1,200 rpm. Function and performance were not affected, but GM had to react under the increasing public scrutiny. After all, these cars weren't cheap to buy, and rattling sounds at idle were unwelcomed by owners of these sinister brawlers.
The result was a nationwide warranty-repair campaign (as described in GM Service Bulletin No. 13313) launched in May 2014. Because GM didn't want to risk having service technicians disassemble the faulty blowers and affect spot repairs, they simply yanked the entire supercharger unit and replaced it with a fresh (and upgraded) assembly. As for the take-off units, some got smashed by sledgehammers and others wound up on eBay.
With more than 20,000 LSA engines affected by the repair campaign, a large chunk of loud-but-functional, take-off superchargers suddenly showed up online for less than a grand.

That service bulletin can be found here, as provided at the NHTSA government website.
Meanwhile our DOTARTS/ACCC websites sucks for vehicle recall and technical information... they've even deleted and then dumbed down the old FORS technical info... :mad:

Thats good that Holden did the correct thing from an ACL statutory warranty perspective for HSV owners since they manufactured the base car with LSA…

But it just makes Holden’s attitude towards those horrible engine noises @VCoz has even more puzzling.

If a bit of grumbling in a LSA supercharger at engine idle is enough to replace the supercharger under warranty, when it doesn’t impact performance or longevity according to GM, why wouldn’t a rather noisy LS3 qualify for an engine replacement using that same logic as Holden used on the LSA?

VCoz’s small claims case will be interesting if/when such inconsistencies are highlighted (if it even gets that far)…
