all dependent on the shells he used and what type of shot gun as it was un-registered chances are he was using what ever shells he could get, could have even been rock salt or bird fright which would have limited effect as opposed to a man stopper like 00-buckshot which usually has 7-9 pellets (or shot)

and the size of the shot gun, if it was a "field" shot gun they a very long,
i use a "coach gun" which has a barrel only 20" long so very easy to wield and level

the cops had no choice but to charge the guy but its up to the judge to convict him and chances are he will get let off easy seeing as he didnt kill them and obviously feared for his life
