    It all depends on the officer and your video. Does the video show you had a 3 second gap between you and the van ? If not bend over ! In NSW if you are guitly of following too close and hitting car in front you usually get negligent driving, 3 points and about $380. Thats if the damage is bad enough that a tow truck was required for any of the vehicles.
    If every little acco like this went to court there would be a 2 year wait before the hearing..

    Doesn't matter if you're following too close or if the person in front hits the anchors with no warning for no reason..


    If you're the one behind.. You're 99 times out of 100 the at fault party.. However you can be at fault and not be issued a traffic infringement notice. I crashed into the back end of a Nissan sigma years ago and didn't get fined. The old bird driving had stopped in the middle of the road waiting for the sun to pass as it literally blinded you on that stretch..

    Insurance pegged me as the 'at fault' party but the police on the scene didn't issue me a ticket.

    Also can depend on what the other drivers such as Jag driver says, if he tells cop you were up his ass driving like an Ahole then you are very likely to get a ticket. Your video should help with that though so you will at least get what you deserve.... Make a copy of the video before you hand it in too !

    cool story! so what you are saying is not only were you too close to the van, you were also too close to the car in front of the van for the speed you were travelling at?

    Don't tell the police you were distracted by the car on your side. They might slap you with 'driving without due care and attention', for not watching the car in front.

    If the cops mail you a ticket, cop it and don't say anything else. Anything else you say will put you in a worse position.

    Many years ago I ran up the back of a car merging in front of me. He took off in hurry like he was going to merge so I looked behind me to check for traffic and saw a clear spot and prepared to take off, looked in front of me and the guy in front for some reason had slammed the brakes on...... I went straight up the back of him. I was at fault and accepted that, but it's not like I was being reckless etc.... it was an accident. I've learned a harsh lesson since, not to go until I literally see that car in front of me merge into the other lane of traffic.

    shame to see your pride & joy smashed up
    but judging from the pics, the damage probably is more bolt on stuff which makes it a lot easier and cheaper to repair.

    lucky it's a late model car, where parts are still readily available. I hope I never stack the VH, even decent quality second hand bits are getting very difficult to source, let alone new stuff.

    even if you wern't traveling too close, you will only get a small fine for failing to stop causing inncedent, the cops HAVE to blame someone its the way it is.. if there is a 10 car nose to tail, its the 10th car that gets ALL the blame, 90% of drivers drive too close (my missus is the worst) its nothing to worry about dude, you wont lose your licence. if your in NZ you'l only get a $150 fine and 30 demerits. oh and your insurance excess ! wrong place at the wrong time. If in doubt, bail out !! :)

    Maybe in NZ but that is not the case here. In Aus the police look to establish the facts surrounding an indecent and then apply charges if they are warranted.

    How do you know that?

    Yet he's not in NZ so i'm not sure how you can draw such a conclusion.

    Police don't have to pursue the matter if its not in the public interest to do so, this applies to certain criminal offences too.

If you crash into the back of someone thats failing to stop causing incedent. No two ways about it. How can their be a car accident and noone be at fault??????? someones gotta cop it.

    Im sorry im refering to the way it is here in NZ, if their was a 10 car nose to tail the last car gets the blame, less paper work for the police and 1 insurance claim. The dude has had an unfortuntate accident. He'l be sweet, small slap on the hand.

    Sorry i must also put (I know its in aus) that in NZ you actually get a fine on the spot for failing to stop, no court hearing unless their has been an injury and or the driver is under the influence of alcohole or drugs..

    Just ignor me everyone, im in the wrong country !!!:)

    Well, the good news is I got a caution only. I guess there were enough witness statements to corroborate my own, and as I don't even have a speeding ticket I'm taking this as my first and final caution. I'm happy with this result.

    Yes, I got the blame and rightly so, it was my fault. I'm 100% accepting of that and the charge of "failing to stop". So yeah, it's all good now, everything is over and done with and I should have my car back in just over a week. Hooray!

    So did you get a ticket for "failing to stop", not sure what state you're in but
    in Qld that doesn't even exist. And if you got that "charge" as you say, how could you have got a caution?

    it really isn't that spectacular a crash.
    If the van didn't get a flat tyre he would have driven off. It's also great to see so many witnesses just leave the scene. It took the guy in the black 4x4 to see that no-one else was stopping for him to stop and check if everyone was alright. You can also see him narrowly avoiding the "P" plater that caused the traffic to stop right before the van spears off the road.
