The laws are all different in each state as far as road rules go, but I can tell you 100% in Qld the answer to some of the Q's and how to look it up on net.
-it is illegal for the driver to consume liquor whilst driving (main reason is it will give a false reading on the breath testing devices if you just had a swig, and you would then be detained and taken to station and put on another instrument. It is a big fine too)
-you can't have open alcohol in a vehicle as the vehicle is not some sort of magical environment seperate from the world....if the car is in a public place, then the Qld Liquor Act applies (otherwise it is like having a portable licenced liquor bar!)
all this stuff can be googled under Qld legislation.

Police can use discretion and that is why some get fined and some don't.
The drivers attitude also has a lot to do with it.
