So last night driving to the airport to drop the parents of to fly out on holiday driving through a green light and some lady on the opposite side in a straight ahead lane turned right out in front of me and then bam cars apparently written of we are all alright just bruised. Not a very happy camper ATM especially after spending bit of coin on it lately.
That's unlucky mate, hopefully it was insured for enough to somewhat replace it. Airports are shocking....

Don't go counting your chickens just yet. Wait till the assessors look at it and determine if it is a write off and how much blame you share for the accident. Believe it or not the only time you get 100% no fault is when you are stationery and hit from behind. The insurance company will say you entered an intersection when not safe to do so, a green light is only a guide to enter an intersection, it is still your duty to ensure nothing is coming before you enter.
But she is completely at fault. She turned from a straight lane. Looked like a nice car. It's a bad feeling when looking at your own car, being taken away. Most of us have been there
Sorry Clair but you are wrong.. Lady running a red light is 100% at fault for undue care and attention and failure to obey traffic signals.. Sometimes when they can blame shift two insurance companies will agree on an assigned amount of blame to the two parties and split the cost basically.. But that's when circumstances are a bit fuzzy..
Yeah no Clair bear, same thing happaned to me when i had a diahtsu charade, i went through an intersection on the green, an n old man went through a red light and hit me, writing of my car. He was 100% at fault and he had to pay for the damage.
I thought u were always at 10% at fault no matter what when u got on the road and the other insurance company might say u fallen to give way to your right so u never know what insurance company's may do

All Clair is trying to say is the fault may not be 100% to the other driver, at no part in his story does it mention a red light. A green light is only telling you that you are able to proceed into an intersection, it is still your responsibility to ensure the intersection is safe to enter.
If he had a green the side street had a red.. Unless 3 red lights on that approach weren't working.. So short of major circuitry stuff up there is no portioning blame on this accident..
Ouch, looks like a decent hit mate. Good to hear no-one was hurt. In regards to who is at fault, etc. There is not a single situation where the insurance companies "at fault" decision can be assumed 100%. This is because, at fault is determined though an agreement between the 2 insurance companies. Yes, 99% of the time common sense prevails, but it can go either way. Thus why you should NEVER admin fault after an accident even if you think it's blatantly obvious it was because if your insurance company decideds it doesn't think you're at fault, they will not cover you while the other insurance company will pursue you since you admit it was your fault. Something to keep in mind.
However if the police assign no Blame to one party and fine the other no insurance company can put any blame on both.. Trust me..
You do realise you contradict yourself here. First you try to tell me I am wrong, then go on to admit that Insurance Companies can apportion the blame. Guess that means I am not wrong as that is what I said in my post.
Insurance companies can apportion blame as part of their internal workings to split the cost.. However of they were passing on actual 'fault' both drivers would be required to pay an excess (assuming both had comprehensive insurance). The insurance companies may agree to 99/1 split but as far as it matters he is 100% not at fault so he won't be either charged or have to pay an excess.. Clair I'm not looking to start an argument and I probably could've explained myself better.. But I investigate and analyse car accidents for a living... I'm not just spruking ****.
wow looks like a nice car. wait and see what the insurance company says if its repairable or not... mine was a repairable writeoff..... and dont listen to tow truck drivers, they are full of doom and gloom, mine was telling me the worst, but when i started getting quotes it was looking better. like i said, all i can say is wait to see what the insurance company says, if its repairable or not. then weigh up the options if it is repairable. how much you luv the car, if it is your pride and joy, repair it! if not then just go buy another. i loved mine enough to spend 9 grand on repairs. no way was i going to be able to replace it for that price with anything close to what it is. if i did go buy something else i know i wouldnt be happy with it. as so many of us know, it all seems like doom and gloom now but in a few days it will start getting better. hope it all works out for ya.
