I have something similiar to this on my 1998 VT commodore Exec, but looks more like this

Is this legal? Someone said it isn't as it is missing that part near the bottom

Also it has a crack near the centre, can this be welded or should i look at replacing it

You're missing your rear resonator, which is legal, as long as your car stays under the legal decibal limit for noise emissions. With a resonator you won't have the drone you would have currently.

The crack is very dangerous (leaking fumes into your cabin possibly). Get that fixed ASAP, just replacing the pipe would be a better solution, and probably cost similar to welding it up.
