I imagine the police would have to see you driving recklessly, just like if you were to be tailgating etc. In court it would be their word against yours, but seriously no cop (well very few) would ever make up charges just because they can

i see a slight darker patch, be a bit of a stretch to call it a shadow, think the pic might be too small to make much judgement though.
