If it's going to take retrospective legislation it shouldn't be done. Never, ever, retrospective legislation.

Its a very very dangerous line to flirt with. Especially when you start trying to legislate your way out of a hole like this.

Going forward, even the threat of this is a danger to future investment from the private sector. A risk I would have thought Andrews, who is looking to finance the Metro Rail project, would have distanced himself from.

I know its going to sound totally bias, however if the LNP suggested something like this I would have exactly same view. For a political party to even float a move like this is a scathing indictment on their judgement and their ability going forward. Contracts are there to protect both parties. If lets say Lend Lease bailed, the Commonwealth would be seeking restitution. If contracts are not worth the ink theyre written in because a Govt can essentially pass a law, what confidence does ANY investor have in the Public Service sector. This is a warning to them not to get involved with any Government in the final ~2 years of their term. Work like this takes a long time to plan and look, yes it looks bad being signed 3 months before the election. However they did ALL the ground work for this project and wanted to show the electorate that. If Labor is in this position in 2 years time and they are starting their Metro plans a contractor will be very hesitant to get into bed with them incase they get voted out.

Very very dangerous talk and a lot of people do not quite understand the ramifications.

This is something im very interested in. When I was doing Law, property and investment was one of the areas I was looking at getting into. Very interesting but very scary discussions from Pallas and Andrews.

Not at all in this case Grennan. Retrospective legislation should never happen. No way could I defend it.
