It's illegal not to carry a spare so if you get pulled over around town and the cops check you are gone.

It's not considered unroadworthy here in the ACT also.

And splitting hairs, being unroadworthy (unknowingly/unobviously) isn't 'illegal' in itself until it's deemed unroadworthy by some form of governing body, then it's illegal to drive. The trouble with deeming such things illegal means that you're committing a 'criminal act' to have a flat, replace it with your spare and then then drive to a shop for repair.
